Child custody disputes can be traumatic for both parents and children alike. While you are living with your children, you have unlimited time with them. While you are in the midst of a divorce or separation you do not have that access, and it is disruptive and distressing. It is better for your child if you can negotiate a child custody arrangement with your spouse or the child's other parent. This isn't always possible, however. There are times when you need to litigate child custody, particularly if there are issues of domestic violence or abuse.

In Massachusetts, the best interests of the children will govern any decision regarding who has custody and visitation rights. From the court's perspective, in the absence of abuse, children are best served by having two involved parents. Children need to know they are loved. Children also need the security of knowing they will continue to have a significant relationship with each parent. To negotiate a parenting plan that meets your child's needs, it is important for you to put your child's needs first and your needs second.

My goal as your lawyer is to help you determine what is in your child's best interests and how those interests can be met now and over time. Children grow and their needs change, so a parenting plan should be flexible. If a plan is not meeting the needs of your children as they grow, I can help you seek a modification. Mediation and collaborative law are options that can help you avoid a child custody battle in court.

In highly-contested child custody cases, the court may appoint a guardian ad litem to represent the interests of the child or to determine what is in the child's best interests. I often serve as a guardian ad litem for the court in cases in which I do not represent either of the parents.
