Massachusetts is an equitable division state. Equitable, however, does not mean equal. It means reaching a fair settlement in consideration of your financial needs. All assets are subject to equitable division, whether accumulated before or during the marriage, including gifts, inheritances, retirement and pension plans. In Massachusetts, it is not a critical issue whether the asset is in your name, your spouse's name, or a third party's name. The critical issue is how we can fairly divide those assets to address your financial needs.

Massachusetts courts consider 15 factors in determining what is equitable. These factors include the length of the marriage, conduct, age and health of the parties, station, occupation, amount and sources of income, vocational skills, employability, estate, liabilities and needs of each of the parties, and the opportunity of each for future acquisition of capital assets and income, present and future needs of the dependent children, contribution in the acquisition preservation or appreciation in value of their respective estates, and the contribution of each of the parties as a homemaker to the family unit.
